Terms, Conditions & Privacy Policy
In order to use joboxi's website, or any of its services, individuals must read, understand and agree to this Terms, Conditions & Privacy Policy document in its entirety. The document consists of Five sections in addition to this introduction: (1) Definitions pertaining to the entire document, (2) Terms of Use, (3) Privacy Policy, (4) Conclusion, (5) Contact Information.
Failure by anyone to adhere to any portion of the following policies shall result in the immediate removal of any accounts or personal information of such person using this website or its services.
(1) Definitions
The following terms are used throughout this policy, and shall retain their definitions for the duration of this policy unless explicitly redefined in a particular section. Definitions are extended to their various conjugations, tenses, plural forms, and are case-insensitive.
- Joboxi: the website at http://www.joboxi.com, any of its mirror websites, subdomains, services, subsidiary pages, sub-directories, parent directories, or message boards, forums, software applications, and/or other similar products as owned by joboxi.com or defined as pertaining to joboxi by its parent company, devbox2 (http://devbox2.com).
- User: Persons knowingly or unknowingly visiting or using Joboxi.
- Adult: An individual 18 years of age or older, or the legal age of Adulthood in the individual's respective jurisdiction.
- Minor: An Individual beneath the age requirements defined for an Adult.
- Post: Any content and/or materials consisting of text, images, video, audio, text, files in any format, or other media transmittable to Joboxi via any reasonable method available to Joboxi or the supplier, so that it may be stored and/or publicly displayed by Joboxi or any of its affiliates.
(2) Terms of Use
A. Legality of Posts
Users must to adhere to all laws and regulations outlined in the cities, counties, states, countries, or other regional jurisdictions for which they create Posts using Joboxi. By supplying content to Joboxi in the form of Posts, Users certify that they are aware of the laws and regulations affecting their actions, and hold Joboxi free from any liability whatsoever regarding such Posts, or any portion of their content. It is the sole duty and responsibility of Users to ensure that the posts they supply to Joboxi are of legal nature. If any post is found to be in violation of applicable laws and regulations of the area in which it is supplied, Joboxi will immediately remove said content from its website and other properties, with or without notice. Joboxi reserves the right to remove any content it considers to be potentially unlawful, dangerous to the safety of itself, its affiliates, its parent companies, or any User of Joboxi. Users must report any and all illegal content to support@joboxi.com
B. Intellectual Materials and Copyright
Any and all materials posted or uploaded to Joboxi by Users, as well as any content created by Users on User's pages is the sole property of the individual copyright holders and/or creators of such material. Joboxi does not claim any ownership, nor does it express a desire for ownership of any materials provided to Joboxi. By posting or making content available to Joboxi Users grant to Joboxi or its designees a nonexclusive, royalty-free, transferable, irrevocable, world-wide license to use, copy, modify, prepare derivative works from, distribute, publicly display and publicly perform by any method and process such content, or any part of it, including without limitation (A) adapting the format of such content for display on joboxi, and (B) displaying Users' public content in search results generated by the a search engine. In addition, Users give their consent for Joboxi and/or its service providers, to view any User content at any time for the purpose of providing the Services and filtering content that violates this Agreement. Users acknowledge that they are solely responsible for all Content submitted by them to joboxi. Users represent that they own any posted or uploaded content, or have the rights necessary to grant Joboxi the aformentioned license.
Users may not post or upload any material which they do not own or hold the sole rights for possession, transmission or display in any medium. Users are solely responsible for ensuring that they possess the required copyrights or ownership of materials which they post or submit to any of joboxi's websites. Joboxi shall not be held responsible or liable for the posting of content in an illegal manner or fashion by Users or visitors of its websites or services. Joboxi will take any reasonable action which it deems necessary to protect itself from the violation of ownership or copyright on any content located on any site of joboxi. Joboxi reserves the right to remove or delete any content which it believes is in violation of the copyright laws of the United States or another country, whether Joboxi arrives at this conclusion of its own dissention, or whether Joboxi has been informed by a knowledgeable third party, or by any other informative method. Copyright violations will be taken with the utmost seriousness by joboxi, and any and all violations of copyright law pertaining to any content located on any User's page or Joboxi webpage must be reported to support@joboxi.com immediately. Joboxi reserves the right to suspend or delete the accounts or personal information of any User who violates the copyright policy of Joboxi or any other policy or procedure of joboxi, and to report such violations to the appropriate authorities in joboxi's jurisdiction.
C. Obscene and Inappropriate Content
Inappropriate and/or Obscene Content is strictly forbidden on Joboxi. Posts by Users are publicly viewable, searchable, accessible and downloadable by any person visiting or viewing the site. Joboxi will use its best judgment in ascertaining what types of materials violate this User policy and/or the federal, state, or local laws governing joboxi's ability to run its services. Joboxi shall consider the following types of images to be of an inappropriate and/or obscene nature, but shall not limit its definition to only these types of images: Images that contain nudity, lude content, perverse actions, illegal drug use, images of extreme violence, images depicting illegal acts involving animals or Minors, otherwise pornographic images, or content that is, under joboxi's judgment, unsuitable for viewing by Minors or others. Users must exercise their best judgment while using any of joboxi's services. In the event that Joboxi feels that any User is in violation of this policy and/or federal, state, or local laws, Joboxi shall suspend or delete any accounts, and/or report to the appropriate authorities any conduct, of such Users as it deems necessary.
D. Age Requirements
A User must be an Adult to use Joboxi. A Minor is not permitted to use Joboxi or any of its features and/or services for any reason, at any time. Joboxi will not knowingly accept any information, personal or public, from Minors. Joboxi will not knowingly disclose any personal information of any Minor, in the event that it is inadvertantly gathered, except to the appropriate authorities and or agents as outlined in the Children's Online Privacy Protection Act of 1998 where applicable. Joboxi reserves the right to remove the accounts and personal information of persons believed to be Minors and therefore in violation of this policy.

E. Moderation and Monitoring
Joboxi, as part of its duty to prevent the dissemination of illegal content, obscene content, pornographic content, Adult content, unauthorized copyrighted content or otherwise illicit content that violates the terms of this agreement, shall periodically moderate or choose an appropriate agent to moderate on its behalf, the various pages that make up joboxi's services. The moderation of joboxi's services shall, from time-to-time, include the viewing of User accounts as Joboxi deems necessary. Perusal of User accounts and/or User information can and will occur at any time, without notice. By accepting the terms of this agreement, Users give joboxi, and any of its appropriately defined agents, their permission, though this permission is not required, to enter, view, and collect any information from their accounts at any time, for any reason, and without prior notification. Joboxi shall act as it deems sufficient and necessary to remove any information that violates the terms of this agreement including, but not limited to, the deletion of information from User's accounts, databases, and publicly or privately viewable webpages and resources. Joboxi shall report any illegal activities of Users and or visitors to the appropriate agencies, as Joboxi becomes aware of, or is made aware of by any person, law, agency, or agent within the jurisdiction of joboxi's operation.
F. User Accounts
Users must immediatley notify Joboxi if they believe that their Username or password has been compromised. In the event that Joboxi believes that a User's account may have been compromised, Joboxi reserves the right to indefinitely suspend the usage of such accounts for any period of time. It is the sole responsibility of Users to maintain and safeguard their Usernames and passwords. It is the sole responsibility of Users to ensure that they do not disclose any of their account information, Username, or password to any person or third party. Joboxi will not contact Users to ask them for their personal information, Username, or password in writing, electronic messages, or by phone or any other method whatsoever, other than within the website(s) of Joboxi or its affiliate websites. If Users believe they may be the target of an attempted identity fraud, Users should contact support@joboxi.com or the appropriate authorities immediately. Joboxi shall not be held responsible for the dissemination of inaccurate information by Users to Joboxi which results in a communication or delivery error of any kind. It is the responsibility of Users to provide complete, accurate information to joboxi.
Joboxi reserves the right to terminate any User account, at any time, without notice, for any reason including but not limited to the violation of any of joboxi's Policies or Procedures or Agreements. User's may terminate their account at any time by following the instructions located within their User accounts, if available, or by contacting support@joboxi.com.
G. Email and Short Message Service (SMS) Messages
Registered Joboxi Users will, from time-to-time, receive email correspondence regarding promotions, events, site upgrades, modifications to User accounts and settings, maintenance and outage notifications, news, added features, and other topics relevant to conducting business online. Futhermore, Users will receive email correspondence that they have initiated when contacting Joboxi, Replying to a Post, Receiving Responses from other Users regarding User inquiries, during the attempted recovery of passwords, when exceeding daily allowed limits for Emails or Text Messaging/Short Message Service (SMS), or other business-related concerns regarding Joboxi and the User. By supplying an email address to Joboxi, Users agree to receive email correspondence from Joboxi, and Users agree that to limit the number of emails they receive over a period of time, that they are to log into their User accounts and adjust the settings for receiving correspondence accordingly. All solicited and site-related emails contain specific information regarding the Joboxi opt-out policy, and give concise instructions for opting out of future email correspondence.
By providing a mobile phone number to Joboxi, and by enabling the 'Enable Text messaging via SMS' feature in the User Settings area, users acknowledge the solicitation of Short Message Service (SMS) messages, also known by the terms 'Text Messaging, 'Texts', and 'SMS'. Every SMS message delivered by Joboxi contains concise instructions for opting out of future messages. By opting to receive SMS messages from Joboxi, Users acknowledge that additional fees may be applied by their phone service providers for such messages. Users should speak with a representative with their respective providers to ascertain these fees, if any.
Joboxi will never ask for User account information in Email or SMS correspondence. Users should Disregard any 'spoof' emails requesting User information, passwords, or other personally identifiable information. Users should contact spoof@joboxi.com and forward any messages requesting User account information.
(3) Privacy Policy
A. Creating an Account
In order to use certain features found on Joboxi, Users will be required to create a User account as outlined in the Terms of Use above. Users understand that the creation of such accounts will require the collection of personal information to be stored in a secure database located at Joboxi.
B. Information Joboxi Collects
Collection of User information may include, but will not be limited to the following: name, address, phone number, email address, unique computer IP address, financial information provided during purchases, such as credit card number or bank account information, and demographic information such as zip code, postal code, hometown, gender.
C. How Joboxi Uses Information
Information collected by Joboxi is used to personalize User experience, improve Joboxi, process sales transactions, send periodic emails that include easy-to-follow opt-out instructions at the bottom of each message, to administer a contest, promotion, survey, or other site feature.
D. How Joboxi Protects Information
Information collected by Joboxi is stored in a secure database and all sensitive information is transmitted via Secure Socket Layer (SSL) technology between the server and client. Payment information is encrypted and transmitted to Joboxi's geteway providers' databases and is only accessible by those authorized personnel with special access to such systems.
E. Methods Joboxi Uses to Collect Information
Users consent to the use by Joboxi of such devices including, but not limited to Cookies, Session-Cookies, Session-Identifiers, Web Beasons. The usage of these devices and/or methods of data collection are for the purposes of managing User accounts, improving website content or feature development, tracking webpage visits and/or usage, and for monitoring the security of the website and its contents.
F. Third Party Information Gathering
The following information pertains to advertisements and third party devices found on joboxi. These Services may include the use of images, text, or banners used by advertising affiliates for the serving and/or targeting of ads, promotions, and other marketing messages. The ad service provider may place or utilize their own unique cookie on a User's browser, and may use information about a User's visit to their sites or Joboxi and its sites. This information may include details such as the number of times a User has clicked or viewed advertising links. Joboxi shall not be held responsible or liable for the collection of information by third party affiliates or individuals. Joboxi shall not be held responsible or liable for any damages incurred to Users or their machines while viewing third party websites or when clicking advertising links provided by third-party affiliates. Joboxi is not liable for the actions of third-party affiliates. Joboxi does not sponsor, endorse or guarantee any products or services advertised by third parties. Google, as a third party vendor, uses cookies to serve ads on the Joboxi website. Google's use of the DART cookie enables it to serve ads to Joboxi Users based on their visit to its sites and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google.com and viewing its appropriate polcies. Additionally, Joboxi uses analytics tools supplied by Google to track trends and site usage. Users may visit Google.com for more information regarding analytics usage.
G. Dissemination of Information to Third Parties
Joboxi does not sell, trade, or otherwise transfer to outside parties personally identifiable information of Users. This does not include trusted third parties who assist Joboxi in operating its websites or products, so long as those parties agree to keep said information confidential. Joboxi may also release User information when it believes release is appropriate to comply with the law, enforce its site policies, or protect its or others rights, property, or safety. However, non-personally identifiable User information may be provided to other parties for marketing, advertising, or other uses.
H. California Online Privacy Protection Act Compliance
Joboxi values User privacy and has taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. Joboxi therefore will not distribute a User's personal information to outside parties without that User's consent.
I. Children's Online Privacy Protection Act Compliance
In accordance with the Terms of Use outlined above, Joboxi does not knowingly accept the personally identifiable information of Minors and is therefore in compliance with the requirements of COPPA (Childrens Online Privacy Protection Act). Joboxi does not knowingly collect any information from anyone under 13 years of age. Joboxi's website, products and services are all directed to people who are at least 18 years old or older, or otherwise defined as Adults by the Definitions contained in Section (1) of this document.
J. Online Privacy Policy Only
This Privacy Policy applies only to information collected through Joboxi's website or other online products and services, and not to information collected offline through phone conversations, written correspondence, fax transmissions, face-to-face interactions, or other methods not limited by the use of a web browser.
(4) Conclusion
Joboxi will immediately delete all content and deactive the accounts of Users believed to be in violation of its policy as outlined in this document. Joboxi reserves the right to amend, change, or alter any portion of this document at any time, without notice, or to replace it in its entirety. Use of Joboxi is conditional upon the agreement with and adherence to this User Agreement and Privacy Policy. Users acknowledge that by using Joboxi, that they agree to the content of this User Agreement and Privacy Policy in its entirety. Users also agree that any future visits to Joboxi acknowledge the continued acceptance of this User Agreement and Privacy Policy, even if it has been updated since their last visit. Joboxi reserves the right to deny entry, membership, or use of any of its websites or services at any time for any reason to anyone.
